This is a translation provided for convenience. The French version is the legally binding one.
1. Scope
These terms cover the website and mobile app services provided by Mathis Ferrandes, entrepreneur individuel (EI) (Tremplin) and the related subscription plans.
Our services are for business clients only (companies, tradespeople, shops, freelancers, associations) ordering for their business. By placing an order, the client confirms they are acting as a business.
2. Ordering and free mock-up
Clients book their project using the form on this website. A mock-up of the homepage is offered free of charge and with no commitment. The order becomes binding once the client approves the mock-up and pays the deposit.
3. Prices and payment
- Prices are those shown on the website or in the quote on the order date. [Prices excl. VAT / VAT not applicable, art. 293 B of the French Tax Code]
- 30% deposit when the mock-up is approved.
- 70% balance before launch. The website goes live once the balance is received.
- Secure payment via Stripe. Accepting these terms is required before any payment.
4. Timelines and changes
The timeline for each package starts once the deposit and all required content (copy, photos, logo) have been received. The number of included rounds of changes depends on the package. Any extra changes are charged at €45 per hour, subject to the client's agreement.
5. Monthly plan
- Every website requires a plan, starting on launch day.
- Minimum 12-month commitment, or longer if the client chooses so in the quote, then automatic month-to-month renewal (or yearly, for yearly billing).
- Yearly billing: 2 months free.
- Cancellation: possible at the end of the commitment period, via “My subscription” or by email, with 14 days' notice.
- The commitment is what allows the reduced build price. If the client stops before the end of the commitment period, the monthly payments remaining until the end of that period are due in full.
- The Commerce plan (or higher) is required for the Shop package.
6. Unpaid invoices
If a plan payment is missed and a reminder goes unanswered for 15 days, the website may be taken offline until payment is made. If the client stops early, the monthly payments remaining until the end of the commitment are due in full.
7. Ownership
The domain name is registered in the client's name. Once the build has been paid in full, the website and its content belong to the client. If the client leaves, Tremplin provides, free of charge within 15 days and once all amounts due are paid (including the rest of the commitment), the website files and the domain transfer code so it can be hosted elsewhere.
8. Referral programme
- Referrals are for clients only: your personal referral code comes with your website, when it goes live. You then need an active subscription.
- The new client books their website using the referrer's link: the referral code is filled in automatically.
- The free month is granted as soon as the new client has paid the balance for their website.
- It is deducted from the referrer's next subscription payment.
- No limit: 3 referrals = 3 free months.
- Free months cannot be exchanged for cash.
9. Right of withdrawal
As our services are for business clients only, the consumer right of withdrawal does not apply, except where the law extends it to certain businesses.
10. Cancellation and refunds
- The mock-up is free: nothing is charged until you approve it.
- Deposit: if the client cancels after work has started, half of the deposit is kept to cover the work already done (15% of the build price) and the other half is refunded.
- If Tremplin cancels or cannot deliver, the deposit is refunded in full.
- Balance: only requested once the client has approved the site; it is not refundable after launch.
- Plan: monthly payments already made are not refunded; yearly payments are not refunded either, even if the client stops during the year.
- Refunds are made to the original payment method.
11. Disputes and mediation
We will always look for an amicable solution first. As our services are for business clients only, consumer mediation does not apply. Governing law: French law.
